    You should get something by Saturday. I’m in California and I had a hearing for an appeal on Monday and I got the notice of outcome of the appeal on Thursday of that same week. BTW I lost the appeal hearing and now I’m filing a second level appeal. Wish you the best of luck and hope you win your appeal!!!

    Thank you so much!  I hope you win your second level appeal.  I know it’s frustrating.  All of this has put a serious ripple in our fiances with a 5 week suspension that turned out to be six weeks because of that “waiting period” – that I still don’t understand.

    I’ve been calling daily, just to see if there has been a judgement made.  The first day I called was on Monday, they looked me up by case number, and said “no, no judgement has been made yet, sometimes they are quick, and other times it takes a little longer”.  Second day, “no, no judgement has been made, you can call back”.  Today, “no, it takes a while, normally takes 4 weeks to get the judgement back.”  Frustrating that they can’t all give the same answer.  So Monday I felt hope that I’d get a judgement this week, and today, I feel like I won’t be able to get out of my financial hole any time soon.

    Just interested to see if you got an anwser.  I have my appeal hearing today , I have been without benefits for 8 weeks now ?   I am so nervous, my client lied and said I threatened her ( NOT TRUE ) any advise you can give would be great !

    I haven’t heard anything yet.  My hearing was on the 15th of June, and I’ve called daily to check the status.  One day, a guy told me it takes about 4 weeks to get a judgement made (when I asked to get the status of the appeal, he asked what date my hearing was, I tell him the 15th, and then he didn’t even ask for my case number or social, so I’m guessing he just didn’t want to help).  I called 5 minutes later, and got a different person.   She told me it takes about 2 1/2 weeks to get a judgement.  As of today, I begin week 2 of my wait.  Try not to be too nervous.  The former employer in my case was given notice of the hearing, and no one showed up.  It was just me and the judge in the room, audio recording the hearing.  It was really a quick process once I was in the room with the judge.  When you gathered everything for your appeal, did you gather any email correspondence between you and the other person?  Because all those things are admissible.  At least, they were for me.

    If your employer didnt show, you won your case !!!!  i have heard repeatly with research that if they dont show you win by default !

    Here is what happened :
    My Client lived with me,my husband and children approx. ( 1 year ) she is also my aunt, She is blind and disabled, so I became her caregiver because no one else would. She has a serious addiction to pain medication and gets mad when I wouldn’t give her excess pills. The night of seperation , she got mad and continue to curse at everyone (including my children) saying we were holding her hostage. I called the police and had her removed from our home, and she wanted to go. SHE CLAIMS now that my husband and I threatened her and that’s why the police took her. I have a letter from her prior caretaker who had the same problems, her niece who visited her on a regular basis and a letter from my husband who was there the night this happened.Additional informationAlso i have tooken in many people and cared for them over the years, including 2 children right now. Social service has to evaulate myself and husband in order to care for these children. Which are my teenage sisters. P.S. No one has EVER said anything like this about me. Also EDD never told me the details of what she stated, I didnt get that info. until I filed an appeal and received her statement. – edit

    P.S. I have submitted letter from her prior caretake who had the same problems I had, A letter from her niece who visited her and spoke to her on the phone and a letter from my husband who was there the night this took place !

    Well i had my hearing and employer did not call in.  He read the evidence i provided and said he had no further questions.  Now its just the wait game. What happened at your appeal ?

    Hello Carly,
    Well I called the ADJ this morning, and they said my decision was mailed yesterday.  I am assuming after my hearing.  They wont give me an anwser over the phone , all they will say is that the decision was mailed.  EDD gets the decision electronically , so I called them and they said someone was working on it so they cant access the letter.  They said if it was over turned I should receive my payments on my card tomorrow.  I will be calling ALL day to see what the anwser was.  My stomach is in KNOTS !  Anyway I will keep you posted, anything new with you ?
