How many years does the overpayment penalty follow you?

I lost my job three years ago, went on CA unemplykent, got a job however was assessed 30% penalty overpayment and 13 weeks. I paid the overpayment and penalty back while continuing to work for another year before being laid off again. I just filed with California and that 13 week penalty was waiting for me. How many years of working does it take for that multi week penalty to go away or is it always there waiting to punish you? Thanks.

    That is crazy! You would think that as long as you paid it back, there would be no penalty period. Sorry about this! Just crazy!

    The penalty is the number of weeks you have to claim unemployment without getting paid. To collect unemployment while you are working is fraud, and that’s why the penalties are so high. They make this very clear. So you are going to have to be unemployed and certify for 13 weeks without getting paid.
    Unemployment is not a loan program.
