Well it’s time. I gave EDD several oppurtunities to rectify my issue. My uncle is a lawyer and I’ve started a lawsuit against EDD and Deloitte. I’m sorry you did not take the time to respond to me. Get ready….

      I strongly disagree with you on this. 1. A claimant is “owed” respect which encompasses many subcategories. 2. A claimant is “owed” approved payment on time. 3. A claimant is “owed” an honest response to a failed system. 4. A claimant is “owed” an open working and available line of direct communication in regard to their claim.

      It’s interesting how some perceive unemployment, welfare, and loans. If you are the recipient you are to do as the master says and lick his hands and be grateful. The truth is unemployment benefits are earned by a former worker and their relationship they have established with the former employer. At some point the benefactor provided a service that the employer capitalized on and as part of the gratitude they employer pays into that benefit. Those who end up on welfare may have been working for years and through there own taxes have fed and clothed many. Anyone who grants a loan and degrades the person accepting the loan is a dog. They know the one creating the loan has incurred an additional debt but no where in the deal was their a clause that suggests a person must fall on their needs and eat someones ass.

    you’re probably going to take this the wrong way so I’ll say in advance I’m definitely on the side of those collecting unemployment benefits who have had to wait for payment or who have been jerked around by the system. BUT….

    I’ve done a lot of research legally when it comes to holding the state and EDD responsible for any thing. Every single lawyer from the most skilled to the least will tell you forget about it. You cannot sue EDD.

    If your story is true and you really do have an uncle who is a lawyer he would have already told you. Going after Deloitte you might have a case but singularly it would hang in the rafters for at least a good year and a half. If your idea was to get any compensation wouldn’t it be based on delayed payment that will eventually come through? The amount is so small it would be suggested you head to small claims and then you end up representing yourself.

    The cost to file and go through the process would take just about what you’d be requesting. In fact it may actually exceed what you would be requesting.

    It sucks how the unemployed, disabled, and senior citizens are treated. However, the state has protected themselves from a direct hit to any related agency.

    My suggestion to your uncle if he is a slick lawyer is to take your story to the news. plaster it all over if it’s truly a story of degradation and financial destruction. Milk it so that all the other individuals who have claimed eviction notices and over due bills will come fwd. Then collectively you could possibly file a civil suit suggesting discrimination based on financial status. Again, another long drawn out situation.

    I still say minus all this supposedly getting lawyers and calling the Gov. Why aren’t all these horrible stories being told to the press. The press would love this.

      How about you don’t judge. You don’t know everyone’s story. I am on CTB through the EDD going to school full time in order to better my life. I’m training for a medical career. So why don’t you just keep your mouth shut? Not everyone sits around just collecting unemployment and not doing shit. Or are you just too entiled to judge? You must be a racist too.

          Correction: EDD is not paying anyone. EDD manages the accounts and distributes approved claims. the poster has every right to seek timely payment on those approved benefits. Greed is hoarding. In this situation the word does not apply. They want what they have been approved of based on qualification standards. EDD does not feed, educate or wipe this persons ass. You’ve given EDD a deity status it does not have.

          The individual fairly qualified for every thing available to them. EDD needs to treat the claimant with respect and disburse payments on time. The claimant will continue fulfill their obligation but as a human being they have every right to demand fair and respectful treatment.

            you seemed to take it personally so it naturally seemed like you were the OP. you followed me to a completely different post as if it was you. all i was saying was if he has a “high powered” attorney uncle then he should get a job with him instead of complaining and suing about a check that isn’t coming obviously. how about any job for that matter. mcdonalds, starbucks whatever.

          Let her sue. I think it is an honorable thing to lay out the injustice done by the EDD to a judge. You may be surprised at what a judge will rule. Some care about the poor.

    I say go for it. Maybe you can’t sue edd but try and get media play. That may get more focus on the issues, your issue fixed and answers.
    Search for jensen on this site. He’s a reporter out of Sacramento channel 10. He’s been asking for information for investigative report. You may be able to help each other. No matter what I say good luck!

    A lot of the haters here sound like the house negroes back in slavery days. You losers are too afraid to stand up and fight. If this person has the will to fight and he has a pit bull attorney ready to go after Deloitte and edd then I say go get them! Don’t hate just because you’re a pussy.

      I agree! Thats why I wish those with valid proof of hardship brought on by this glitch would call the media and come fwd. The mother fucker up there making it sound like unemployment benefits is some special gift directly from EDD and peanuts is better than nothing and if you don’t get your peanuts then stop crying about it is either an EDD worker or a self loathing unemployed individual who looks in the mirror every day and has been led to believe they are garbage while collecting. I wish so much I had been a part of any delays because from the second I filed and then fairly qualified for unemployment benefits I was aware of how hard it may be to get it all going. I said from the beginning if any shit occurs with my claims I’ll fight it and fight it hard and not back down with a feeling some how I’m any less of a human being.

      Ya and Deloitte had maybe been paid ninty five million, they may peel off an easy million to save face and avoid such a lawsuit. I say sue and sue hard.

    Good. And in that lawsuit, why not explore if tier 4 should not have been cut off. You see the lead managers at EDD knew on 9-1-2013 that they were not submitting the proper and correct unemployment figures to the bureau of labor statistics. They knew, yet they said nothing. The stock market went up when California reported less people on the unemployment, yet the EDD managers knew the numbers were not accurate. Now the bureau of labor statistics are also in the know. The people at the bureau of labor statistics know the figures are not accurate for July, August, and September 2013, and if you e mail the bureau of labor statistics and ask them if they are going to “adjust the unemployment figures for previous months,” they will e mail you back that they know the figures are not correct so they will do an adjustment on the date of October 22, 2013. E mail them and find this out.

    In the meantime the spokesperson for the EDD says nothing about the cut off of tier four payments which are only six weeks anyways, you see all the weeks for each tier have been drastically cut back, way back, and then sequestration also cut back about twenty percent of the meger payments to the poor unemployeed.

    .In your lawsuit include the devious nature of the EDD managers who knowingly knew on Labor Day Weekend that they would put hundreds of thousands of people into pain and suffering, not paying them for a month or more, some still not paid. And also do some reading on this website, some say a person in Sacramento was so sad that , well you know, read the previous posts about a person hurting themselves.

    As you are in trial, have the EDD managers read some of the sad posts on this website. They may or may not be held responsible for puttting too much pain and suffiering upon the poor.

    yes, file the lawsuit. File it. And let Governor Brown discuss it with you. Let him speak to you directly. He needs to do more than what he has done. He needs to immediatly reinstate tier four due to bad statistics.

    Another way to sue is for, if it is true, that guy in Sacramento who killed himself, well, his family may sue, if it is that he did not get his EDD payments on time. Check the old posts on this site a week back. That was sad and the Governor needs to speak to this quickly. The governor needs to do a news broadcast to reinstate tier four and to assist any person who is in need due to the screwups of the EDD. He does. Sue away in the name of that guy in Sacramento, if it is true. Find out about that.
